Terms of Use

These Terms and Conditions, and any Additional Terms, govern your access and use of the NaitGoal website, as well as any online services, solutions, or facilities offered by NaitGoal through the website. By accepting these Terms, you acknowledge that you have read and understood them, and that they constitute a legally binding agreement between you and NaitGoal. If you do not agree to these Terms, you should not use the website or any of the services offered by NaitGoal.
NaitGoal may make changes to these Terms or any Additional Terms at any time, and any modifications will be communicated to you through the website or the services. Your continued use of the website or services after receiving notice of any changes will be considered an acceptance of the updated Terms.
Throughout these Terms and any Additional Terms, "User," "you," or "your" refers to the person accessing or using the website or services, while "NaitGoal," "we," or "our" refers to NaitGoal Infomatics India Private Limited, its licensors, affiliates, and their respective employees, officers, directors, agents, and representatives.
 

  1. The service provided by NaitGoal is aimed at individuals in India. NaitGoal assists customers by offering different services pertaining to Loans of various types. By accepting the terms and conditions, customers authorize NaitGoal to communicate with them and accept instructions from them through various channels, including telephone, email, writing, and any other mode determined appropriate by NaitGoal. NaitGoal may also recommend its own products and services or those of third-party banks and credit institutions to customers and provide referrals on a non-risk participation basis. However, customers should exercise due caution and seek independent advice before entering into any investment or financial obligation based on these referrals.

  2. The website and service can only be used for personal and non-commercial purposes, subject to the terms and any additional terms that the user agrees to be bound by. The content available on the website is the property of NaitGoal and its licensors and is protected by copyright and other applicable intellectual property laws. The user is only allowed to use the content for personal, non-commercial use, and any other use is strictly prohibited. The user must not use the website, service, or content for any unlawful purpose, and NaitGoal reserves the right to restrict, suspend, or terminate access to the website and service if the user violates any of these terms.

  3. The Privacy Policy outlines the personal information and data that the website collects when a user visits, uses the Service or communicates with the website. It also mentions that the website shares the collected information and data with others and covers other related matters.
    Read the Privacy Policy carefully prior to accepting its terms as it forms part of the website's Terms of Use. It also notes that users have the option to choose what information and data they share with the website. However, if a user chooses not to share the requested information or data, the website may not be able to provide them with the Service or some parts of it.
    Overall, users ne    ed to be aware of the information and data they provide to the website and to understand how that information is used and shared.

  4. The website may contain hyperlinks to third party websites, but NaitGoal does not have control over these sites. By clicking on the links, users will be directed to third party sites that NaitGoal has not verified or endorsed. NaitGoal does not accept any responsibility or liability for any loss or damage that users may incur from their visit or transactions on these third party sites. Users are advised to access these third party sites at their own risk and should review the terms and conditions and privacy policies of these sites before accessing them. This paragraph is essentially a disclaimer to protect NaitGoal from any legal issues that may arise from users accessing third party websites through their site.

  5. NaitGoal acknowledges that it has an obligation to provide the service that the customer has subscribed to and paid for in a professional and workmanlike manner, and will make commercially reasonable efforts to do so. NaitGoal will use its best efforts to provide the service in a manner that meets industry standards and is of acceptable quality. NaitGoal states that, except for the warranty outlined in the preceding statement a, it does not provide any express or implied warranties regarding its service or service on behalf of its partners. This means that NaitGoal is not making any promises or guarantees beyond its obligation to provide the service in a professional and workmanlike manner. Additionally, NaitGoal is not responsible for any issues with the service, including errors or defects, and the service is provided on an "AS IS" and "AS AVAILABLE" basis.

  6. NaitGoal's liability for any loss or damage that users may suffer as a result of a breach of the terms or any additional terms is limited. NaitGoal will only be liable for direct loss or damage that resulted from its gross negligence or willful default, and that naturally arose in the usual course of things from the breach or that are explicitly stated in the terms or additional terms. NaitGoal will not be liable for any damages exceeding the amount received from the user. If the user has not paid NaitGoal, it will not be liable for any damages.

  7. If you breach the terms of the agreement with NaitGoal, including submitting any data or material that violates any third party right or any applicable law, you agree to defend, indemnify, and hold NaitGoal and its directors, officers, employees, and representatives harmless from any losses, damages, costs, and expenses they may suffer as a result. This includes any reasonable attorney fees they may incur in defending themselves against any claims arising from your breach of the agreement.
    In other words, if NaitGoal incurs any costs or damages because of your actions, you are responsible for covering those costs and ensuring that NaitGoal and its     representatives are not harmed as a result of your actions.

  8. NaitGoal has the right to make changes, additions or deletions to the Service that they provide from time to time. This includes the right to discontinue any part of the Service or the entire Service altogether. If NaitGoal does discontinue any part of the Service or makes a change that results in a material degradation or material reduction in the functionality of the Service, then the only remedy available to you as a user is to receive a refund of the charges you may have paid for the Service.

  9. These Terms, as well as any Additional Terms you accept, become binding as soon as you accept them. The agreement between you and NaitGoal will continue until one of you terminates it. NaitGoal has the right to terminate the agreement and deactivate your User ID immediately by sending notice to your email address registered with them if you breach any of the Terms or Additional Terms you have accepted.
    NaitGoal also has the right to terminate the agreement and deactivate your User ID by giving you notice of one (1) day addressed to your email address registered with them. This means that they can terminate the agreement and deactivate your account with just one day's notice. You have the right to terminate the agreement and request deactivation of your User ID by sending written notice by email to NaitGoal at askus@NaitGoal.com. Your User ID will be deactivated within three (3) working days from receipt of such email. This means that if you want to terminate your agreement with NaitGoal, you can do so by sending an email to the address specified, and they will deactivate your account within three working days.
    Upon termination, your right and license to access and/or use the Service immediately cease. This means that you will no longer be able to access or use the Service. Furthermore, your personal information that NaitGoal has in its possession will be dealt with according to their Privacy Policy. This means that NaitGoal will handle your personal information in accordance with the policies outlined in their Privacy Policy.
    The refund will be pro-rated for any completed Service and subject to a maximum of 50% of the charges paid unless NaitGoal has not commenced provision of the Service on the date of such discontinuation. This means that the amount of the refund will be calculated based on the amount of the Service that you have already received and paid for. However, if NaitGoal has not yet started providing the Service when it is discontinued, you may be eligible for a full refund.

  10. Any disputes that arise from or relate to these Terms or any Additional Terms, or your use of the Website or any Service, shall be referred to arbitration by a sole arbitrator appointed by NaitGoal. The venue of the arbitration will be Hyderabad, India, and the language of the arbitration will be English. The arbitration proceeding will be governed by the Indian Arbitration Act, as amended from time to time, and the arbitrator's award will be final and binding on both parties.
    The agreement between you and NaitGoal will be governed by the laws of India in all respects.
    Only competent courts located in Hyderabad, India, will have exclusive jurisdiction in connection with any matter arising from or relating to these Terms or any Additional Terms, or your use of the Website or any Service, to the exclusion of any other court that may otherwise have had such jurisdiction in the matter.
